A NEW SANDHANAYA


The Joint Mechanism as finally published by the government reveals that the fears expressed by the nationalists, based on what people such as Kumar Rupasinghe had said on PTOMS have been somewhat on the lower side of the scale. The document that has been signed by the GOSL and the LTTE is even worse than the MoU signed by Mr. Ranil Wickremesinghe and Prabhakaran. The MoU was signed between the leader of the UNP and that of the LTTE,  and it could be argued that the government of Sri Lanka did not know of it as the President of the country was not aware of such an agreement. It was not presented to the Parliament and though the Sandhanaya government was faithful to it, still it could be argued that there was no legal document as such and that was the reason for not taking steps by the government to abrogate it.

However, one could argue to say that it was an agreement signed between the Prime Minister of the country and the terrorist leader of the LTTE that is at "war" with the government. It is sometimes called the ceasefire agreement (CFA) and that is the very reason that it is not a valid document. "War" can be declared or stopped only  by the President, and as the Prime Minister was not acting for the President and since the President was not aware of the so called CFA at the time of signing, that document has no legal status. Though the CFA had no legal status it attempted to equate the GOSL with the LTTE, and also the Sri Lankan armed forces with the terrorist outfit.

We are aware that the legal system that is operating in the country as well as in the world is Christian by culture and the final verdict is given by judges trained in that culture though they may follow different religions, and even follow no religion. A system based in a particular culture works in favour of that culture, and symbols such as the blindfolded lady only mislead the general public to believe that the legal system is culture independent. No system of knowledge is independent of culture in which the system was produced, and we cannot expect the system to be in favour of the Sinhala Buddhists. Those third rate editors who could at best be called literary critics who have not even a rudimentary knowledge of Philosophy could talk of legends and myths of Mahavansa. However, none of these so called educated people would ever think that the legal system in particular, and any knowledge system in general is objective and independent of culture itself is the most dangerous legend, story or theory. There is no difference between these terms as applied to knowledge as all theories are stories or legends. I challenge anybody to formulate a "theory"  independent of a culture, that gives the criteria to differentiate between a theory and a legend that explain certain "facts". All theories and legends have been formulated or cooked up to explain certain "facts" whose interpretations very often depend on the theories or the legends  that have been formulated to explain them.  

Though the so called CFA was not signed by the President, an organistaion such as the UN which I am compelled to say one of the most powerful organisations established by the western Christian culture to suppress other cultures in the world would accept it as a valid document, if one day that organisation is to "recognise" a separate country in the Northern and the Eastern provinces. The importance of all these documents for Tamil racism and separatism is associated with this so called international recognition. The western Christian countries are determined that the government enters into agreements with the LTTE, since these documents could be used by them for recognising Eelam.

As we have said on several occasions the so called MoU, an invalid document but that can be made legal in western Christian law as and when the need arises,  equated the GOSL with the LTTE, and  the armed forces with the terrorist outfit. The JM equates the LTTE "administration" with that of the GOSL. The fact that the LTTE did not want any party other than themselves and the Government sign the document goes a long way in revealing the strategy of the LTTE and the westerners. The Muslims were not allowed to sign the document though there is Muslim representation in the committees at all three levels. The irony is that at the so called national level, though there is government representation, LTTE representation and Muslim representation there is no Sinhala representation.

I heard at a friend's place Dr. Jehan Perera of national peace council of the Christian churches (how come that most of the "peace loving" people in this country are ex Marxists, neo Marxists and others who as revolutionaries would not object to violence, and Christian missionaries who have not hesitated to resort to violence to spread their religion and culture)  coming on one of those government TV channels  and telling the "ordinary people" who have access neither to the peace councils nor to the wisdom of the NGOs, that there was no Sinhala representation as there was no way of choosing a party that represented the Sinhala people. This is another piece of the wisdom of Dr. Perera perhaps coming through the peace councils. How did Dr, Perera or the westerners and the other peace loving people select the LTTE as the representative of the Tamils. Would Mr. Dvanadan, Mr. Anandasangaree or Karuna agree with the selection of the Christian west and the lovers of peace (piece)?  These lovers of peace select the Tamil representative not based on democracy but on the strength of the arms. The message of the lovers of peace to both the Sinhala and Muslim youth seem to be  arm yourselves and we will "recognise" you for good or bad. This is exactly Christian democracy as has been practiced during the last five hundred years or so.

The representations in the various committees under the JM, make representations in the former legislative assembly look very democratic. In the first legislative assembly there were so called six unofficial representatives in addition to the government or official representatives. The British were so considerate towards the Sinhalas that they saw to it that a Sinhala member was in the legislative assembly. Then there was a Tamil member and a Burgher member as well, though the percentage of the population was nowhere near the 1:1:! ratio worked out by British Christian democracy that is linked to western Christian modernity. The "Sandhanaya" government has been forced by the present day negotiators on behalf of western Christian culture, namely the Norwegians in whose country Lutheran Christianity enjoys almost all the powers, to have an official representative from the GOSL and two representatives one each for the Tamils and the Muslims.

It has to be emphasised that the LTTE has signed the JM document not as a political party and not even as the representative of the Tamils. It has equal status as the GOSL and that is why the Muslim Parties were not allowed to  sign the document.

Only a "Janadhipahi Bhakthi" would believe that the JM would be confined to 2km and be implemented over a period of one year. There is provision in the document to extend these and as we have said before the lovers of peace (LoP) know how to extend them in the name of peace. LoP manipulated the MoU and now they play games with the PTOMS. Who would say that they would stop at that. Whether we like it or not ISGA of the LoP is about to be introduced, may be by a modification of the JM or PTOMS. Whether these acronyms have two letters, three letters or five letters they are all four letter words as far as the Sinhalas are concerned.

The JM was signed not only  because the western Christian LoP and their agents forced the government to do so. It was signed since Ms. Chandrika Kumaratunga of the SLMP who was imported from London by the LoP also was in favour of it.  Locally it is Ms. Kumaratunga  and her henchmen in the government who are responsible for the collapse of the "Sandahanya".  As such it is they who should be sent back to London and other places where they came from. It is up to the nationalists to form Sandhanaya II without the betrayers who think according to western theories, and work to defeat Tamil racism and all the non national forces behind the racists.
